O'Connell, Flaherty & Attmore offers its clients a wide range of services related to intellectual property matters, including trademark registration, trademark, patent and copyright counseling and protection as well as trademark, copyright and patent litigation. Our Intellectual Property Department, which is comprised of both transactional attorneys and litigators, counsels individuals, small businesses and national corporations with respect to all legal aspects of intellectual property development and protection. We help our clients identify the type of intellectual property protection needed in order to safeguard their trade dress, trade secrets, know-how, copyrights, and technology and business procedures, and then work closely with them to determine the best strategy to protect their rights.
At O'Connell, Flaherty & Attmore, we recognize the importance of a company's intellectual property to its value and long-term success. We advise our clients on intellectual property issues that arise in all facets of their business, from contract negotiation to their daily interactions with customers and employees. Specifically, our Intellectual Property Department advises clients with respect to employment and consulting agreements, non-disclosure and non-compete agreements, manufacturing and supply agreements, as well as sales and distributor agreements. In addition, we analyze the intellectual property aspects of sophisticated corporate transactions, including mergers and acquisitions. Our attorneys also assist clients in enforcing and defending their intellectual property rights through trademark, copyright and patent litigation in both federal and state courts.
Our Intellectual Property Department also works closely with individuals and small businesses throughout the trademark registration process, which includes selecting and clearing names and product designations, filing trademark applications with the United States Patent and Trademark Office ("USPTO"), corresponding with the USPTO regarding applications and ultimately obtaining a federally registered trademark for our clients. We also advise our clients as to the advantages and disadvantages of federal versus state trademark registration.
